Welcome to Express Appraisal Management, Inc. (herein referred to as “Express AMC”.) Please read these Terms and Conditions (“Terms”) carefully. They contain the legal terms and conditions that govern your use of and access to our website, as well as our provision of services. By visiting our site, you are signifying your assent to these Terms and our Privacy Policy, which is incorporated herein by reference.
THESE TERMS CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU. THIS DOCUMENT CONTAINS A DISPUTE RESOLUTION CLAUSE. BY ORDERING OR USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND REVIEWED THESE TERMS IN THEIR ENTIRETY, YOU AGREE TO THESE TERMS AND THE PRIVACY POLICY, AND THESE TERMS CONSTITUTE BINDING AND ENFORCEABLE OBLIGATIONS ON YOU.

We reserve the right to modify or update these Terms at any time, with or without prior notice to you, and any such changes will replace any previous Terms effective upon posting to this page. IF YOU DO NOT AGREE TO THESE TERMS, OR TO ANY CHANGES WE MAY SUBSEQUENTLY MAKE, YOU MUST STOP ACCESSING THE WEBSITE, AND IMMEDIATELY DISCONTINUE USING THE SERVICES PROVIDED BY EXPRESS AMC.

All content included on the site, such as text, graphics, logos, images, data, and other material, is owned or licensed property of Express AMC, and is protected by copyright, trademark, or other proprietary rights. Our site may not be reproduced, duplicated, copied, or otherwise exploited for any commercial purpose without our prior written authorization.

Children’s Online Privacy Protection Act Notification
You may only use the site if you are 13 years of age or older. To register for an account or order any services, you must be 18 years of age or over. If you are under 18 years of age, you must have your parent or legal guardian’s permission to use the site.

Member Account
You may create a member account by registering your name, providing certain information about yourself, and creating a password. You agree that you will provide complete, current and accurate information about yourself as requested, and that you will keep that information up to date. You are responsible for safeguarding the confidentiality of your username and password that you use to access your member account on our site. You agree not to disclose your username or password to any third party. You are fully responsible for any actions taken under your account, and you will immediately notify us of any unauthorized use of your account on our site.

Transactions
If you wish to purchase any service through our site, you may be asked to supply certain information applicable to your purchase, including, without limitation, payment and other information. Any such information will be treated as described in our Privacy Policy. All information that you provide to us or our third party payment processor must be accurate, current, and complete. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER PAYMENT MEANS USED TO INITIATE ANY TRANSACTION. You agree to pay all charges incurred by you or any users of your account at the prices in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your purchase. Verification of information applicable to a purchase may be required prior to our acceptance of any order.

Refund and Cancellation Policy
Upon receiving your order, Express AMC will hire an independent appraiser to conduct the service. If you need to cancel an appraisal in the system, please contact us immediately. APPLICABLE CHARGES THAT HAVE ALREADY BEEN INCURRED SHALL BE ASSESSED. All appraisals are subject to a refund if the appraiser has not yet visited the property and completed the inspection. However, any order cancelled after the appraiser has inspected the property will be subject to a cancellation fee of up to half of the appraisal charge to offset loss of business (due to processing costs and the appraiser’s travel costs.)

Additional Charges May Apply
Our goal at Express AMC is to provide accurate pricing information. We always strive to provide you with the most accurate appraisal price depending on the location and loan type. However, the fee for each particular appraisal may vary. THERE MAY BE ADDITIONAL CHARGES DEPENDING ON THE CHARACTERISTICS OF THE PROPERTY, INCLUDING, WITHOUT LIMITATION, SQUARE FOOTAGE, PROPERTY TYPE AND CONDITION. ADDITIONAL FACTORS INCLUDE THE TYPE OF REPORT AND LENGTH OF TIME TO COMPLETE THE SERVICE. UPON INSPECTION, IF ANY ADDITIONAL CHARGES ARE NECESSARY, EXPRESS AMC WILL IMMEDIATELY NOTIFY YOU. YOU WILL BE RESPONSIBLE FOR ANY ADDITIONAL PAYMENTS SUBSEQUENTLY AGREED WITH EXPRESS AMC.

Turnaround Time
Express AMC does not guarantee any specific time frame in which the requested services will be completed. We may refer to specific turn-around times; however these are mere estimates based on average time frames in the past. From time to time, services may take longer than originally estimated, and Express AMC shall not be liable for any claim that may arise based on turn-around time taking longer than originally estimated.

Scope of Work
Any appraisal services requested is considered to be only an ordering of the opinion of the value of a property. Express AMC does not warranty or guarantee any opinions.

Limitation of Liability
You agree that, to the extent permitted by applicable law, your sole and exclusive remedy for any problems or dissatisfaction with the Express AMC service is to discontinue and stop using the service.
TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, NEITHER EXPRESS AMC NOR ANY OF ITS DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES OR AFFILIATES SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPARY OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, PROFITS, OR USE), WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE AND STRICT LIABILITY) OR ANY OTHER LEGAL THEORY.

Warranty and Disclaimer
Express AMC endeavors to provide the best service we can, but you understand and agree that the Express AMC service is provided “as is” and “as available”, without express or implied warranty or condition of any kind. YOU USE THE EXPRESS AMC SERVICE AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, EXPRESS AMC MAKES NO REPRESENTATIONS AND DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE, THE ACCURACY OR COMPLETENESS OF SITE CONTENTS, OR THAT EMAILS SENT FROM EXPRESS AMC ARE FREE OF MALWARE OR OTHER HARMFUL COMPONENTS. EXPRESS AMC DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES WITH RESPECT TO THE SITE AND THE SITE CONTENTS, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold Express AMC harmless from and against all damages, losses, and expenses of any kind (including reasonable attorney fees and costs) arising out of your use of the site, your breach of these Terms, or your violation of any laws or regulations or the rights of another through the use of the site. These indemnity obligations will survive termination of these Terms and the termination of your account.

Third-Party Sites
Our site may direct you to sites or services owned or operated by third parties. We have no control over and are not responsible for the content and operation of such third parties, or the privacy or other practices of such third parties. You should carefully review the policies and terms of such third parties.

Termination
Express AMC may terminate your access to our site and to your account at any time, with or without cause, and with or without prior notice. Without limiting the foregoing, we may terminate your access if you violate these Terms. Upon termination for any reason, your right to access and/or use our site will immediately cease. We may delete any information, files, or materials in or related to your account. You agree that we will have no liability whatsoever to you or any other party as a result of a termination of your access to our site and to your account.

Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of California. If any provision of these Terms, or the application thereof to any person, place, or circumstance, will be held by a court of competent jurisdiction to be invalid, void or otherwise unenforceable, such provision will be enforced to the maximum extent possible; or, if incapable of such enforcement, will be deemed to be deleted from these Terms, and the remainder of these Terms will remain in full force and effect.

Arbitration Agreement
You agree that any dispute, claim or controversy arising out of or relating in any way to Express AMC, these Terms and this Arbitration Agreement, shall be determined by binding arbitration or in small claims court. You agree that, by agreeing to these Terms, the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and that you and Express AMC are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision shall survive termination of these Terms and the termination of your account.

Entire Agreement
These Terms, our Privacy Policy, and other agreements referred to herein constitute the sole and entire agreement between you and Express AMC with respect to the site and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the site.
